Terms of Service
These are the terms under which Journal is offered. By creating an account or using the service, you agree to them. If you don't agree, don't use the service.
This document is intentionally short. We've tried to write it in plain language. Where the law requires specific phrasing, we've kept it as short as we can. Words in bold are defined where they first appear.
Who we are
Journal is a tool for tracking sales, prices, and crafting knowledge in The Elder Scrolls Online (ESO). It includes:
- The Journal web application at journal.erros.gg
- The Journal Companion in-game addon
- The Journal Companion desktop application
- The marketing and community site at erros.gg
Journal is built and operated by Erros, an individual creator. Throughout this document, "we", "us", and "our" mean Erros operating Journal. "You" means you, the person using the service.
Journal is fan-made software. It is not affiliated with, endorsed by, or sponsored by ZeniMax Online Studios, Bethesda Softworks, Bethesda Game Studios, ZeniMax Media, Microsoft, or any related entity. The Elder Scrolls Online and all related trademarks belong to their respective owners.
What you're agreeing to
By using Journal, you confirm that:
- You are at least 13 years old. The Elder Scrolls Online is rated 13+ (PEGI 16 in the EU); the same minimum applies here.
- You will use the service in good faith, as described below.
- You will not use the service to harm yourself, other users, or the service.
What we provide
Journal is offered as a service. We try to keep it running, accurate, and useful. We do not guarantee uninterrupted availability, perfect accuracy, or that the service will continue to exist indefinitely. The service may change, get new features, lose features, or be discontinued.
Pricing
Journal is currently free to use. We may introduce optional paid features in the future. If we do, we'll announce changes in advance and the existing free functionality will not be suddenly removed without notice.
If you support Erros on Patreon, certain Patreon tiers may unlock additional features in Journal. The Patreon relationship is governed by Patreon's terms, not these. Cancelling your Patreon subscription removes the corresponding tier features but does not affect your account or your data.
What it does, and doesn't, give you
Journal provides tools, calculations, and aggregated market data based on observations contributed by users. It is informational, not advisory. Numbers in the app — prices, margins, projected profits, recommended listings — are estimates based on past data. They are not promises about what will happen in the game economy, which can change at any time and for any reason (patches, events, supply shocks, market manipulation, etc.).
You are responsible for your own decisions in-game. Don't bet your gold on a Journal estimate without thinking. We're not liable for in-game losses, real or imagined.
Acceptable use
Use Journal in good faith. In particular:
- Don't try to break it. No automated scraping of other users' data, no attempts to bypass rate limits, no probing for vulnerabilities except as part of a coordinated security disclosure (see "Reporting issues" below).
- Don't try to cheat the data. Don't submit deliberately falsified observations to skew aggregate prices. The aggregate is a public good; poisoning it harms everyone, including you.
- Don't impersonate. Don't sign up under another person's name or claim to be someone you're not.
- Don't harass. Don't use any communication features (Discord, Patreon, etc., where they exist) to harass, threaten, or abuse other users.
- Don't misuse the data. Aggregate market data is shown to you as part of the service. Bulk-redistributing it as your own product, using it to power a competing tool, or scraping it for commercial purposes is not what it's for. Reasonable personal use, sharing screenshots, citing prices in posts and videos — all fine.
- Respect ESO's terms. The Journal addon and companion are designed to comply with ZeniMax's addon policies. If you use them in ways that violate those policies (e.g., automating gameplay), that's between you and ZeniMax, but we don't endorse it and may terminate accounts that do.
We may suspend or terminate any account that violates these rules. We try to give a warning first, but we don't have to. Severe abuse — hacking attempts, data poisoning at scale, harassment of other users — may result in immediate termination.
Your data and your account
Your data is yours
The sales, prices, recipes, and other data you upload from the addon are yours. You can export them or delete them at any time. The Privacy Policy explains where the data lives and how it's used.
What we derive from it
Aggregate market prices — the median price of Rubedite Ore on NA, weekly volumes, trend charts — are computed from observations contributed by users. The aggregate is a derived dataset. It belongs to the project, not to any individual contributor, and continues to exist after individual accounts are deleted (in the same anonymized form it always existed in).
This is the same arrangement used by sites like Tamriel Trade Centre and similar community price datasets: individual contributions go in, an aggregate comes out, and the aggregate is the community's.
Account deletion
You can delete your account from your settings page, or by emailing privacy@erros.gg. Deletion is permanent. We do not maintain shadow copies for marketing or analytics purposes.
Intellectual property
Yours
You retain ownership of everything you upload. By uploading data to Journal, you grant us a non-exclusive, worldwide, royalty-free license to use that data for the purposes described in the Privacy Policy — running the service, computing aggregates, showing it back to you. This license ends when you delete the data, except for aggregates that are already anonymized and indistinguishable from any other contribution.
Ours
The Journal codebase, the Erros brand assets (logos, marks, name, typography choices, photographs), the marketing-site copy, the structure of the price index, the API contract, and similar creative work are protected by copyright and other applicable rights and belong to Erros. The source code, where it is made public, is published under the LICENSE file in its repository. Read the LICENSE before assuming you have permission to do anything with the code beyond viewing it.
Theirs
Item names, item icons, recipe data, motif names, character class names, and other in-game content originate with ZeniMax / Bethesda. We use them as needed to refer to the game, under what we believe to be fair use. If a rights holder believes specific use exceeds that, contact privacy@erros.gg and we'll discuss.
Disclaimers
Journal is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not guarantee that:
- The service will be uninterrupted, timely, secure, or error-free.
- The market data shown will be accurate, complete, or up-to-date for any specific item or transaction.
- The service will continue to exist or be supported indefinitely.
This is a small, free, fan-built tool. We try hard, but it's not a financial system, a regulated service, or a contractual undertaking to deliver guaranteed outcomes.
Limitation of liability
To the maximum extent permitted by law, in no event will Erros be liable to you for any indirect, incidental, special, consequential, or exemplary damages — including loss of in-game gold or items, loss of access, lost profits, or any other intangible loss — arising out of or related to your use of the service.
To the maximum extent permitted by law, our total cumulative liability to you for all claims arising out of or related to the service will not exceed one hundred US dollars (USD $100), or the total amount you have paid to us in the twelve months preceding the claim, whichever is greater.
Some jurisdictions don't allow the exclusion of certain warranties or limitation of liability. To the extent the limits above are not enforceable in your jurisdiction, our liability is limited to the minimum permitted by applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless Erros from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your violation of these terms, your misuse of the service, or your infringement of any third party's rights through your use of the service.
Termination
You may stop using Journal at any time, with or without notice, by deleting your account.
We may terminate or suspend your account at any time, with or without notice, if you violate these terms, if your use of the service creates risk to us or to other users, or if we discontinue the service.
The following sections survive termination: "Your data and your account" (as it relates to data already aggregated), "Intellectual property", "Disclaimers", "Limitation of liability", "Indemnification", and "Governing law and disputes".
Governing law and disputes
These terms are governed by the laws of Montana, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these terms or the service will be resolved in the state or federal courts located in Montana, and you and we consent to the personal jurisdiction of those courts.
If you are an EU consumer, this section does not deprive you of the protection of the mandatory laws of your country of residence.
Changes to these terms
We may update these terms occasionally. If we make a material change, we'll notify users via the app and by email at least 14 days before the change takes effect. Continued use of the service after a change means you accept the updated terms. If you don't accept them, delete your account before they take effect.
The "last updated" date at the top of this page reflects the most recent change. Older versions are available on request.
Reporting issues
For security issues, email privacy@erros.gg with the word SECURITY in the subject line. We will acknowledge receipt within 14 days and work with you on coordinated disclosure. We do not currently run a paid bug bounty.
